Kelsen wrote in ink in a single line at the upper right of the front free endpaper recto “With the compliments of the Author.” Condition is near fine in a very good dust jacket. The black cloth binding is square, clean, bright, and tight with bright spine gilt. We note only minor wrinkling to the spine ends and slight bruising to three of the corners. The contents are clean and bright, apart from slight dust soiling to the top edges. We find no spotting and no previous ownership marks other than the author’s gift inscription. The dust jacket, though lightly scuffed with a mildly toned rear panel, retains deep, unfaded hue to the front panel and spine. The jacket is neatly price-clipped at the upper front flap and shows trivial loss at the spine ends and flap fold corners, as well as a tiny hole near the center of the rear flap fold. The jacket is newly fitted with a clear, removable, archival cover. Austrian-born jurist, teacher, and philosopher Hans Kelsen (1881-1973) was the principal architect of the 1920 Austrian constitution. After emigrating to the United States in 1940 at the beginning of the Second World War, he taught at Harvard, the University of California at Berkeley, and the Naval War College, Newport, R.I. This book was published by the University of Chicago in December 1943 during the war that precipitated Kelsen’s emigration. Notable, given the time and the author’s Austrian origins, is Kelsen’s dedication of the book “to the Rockefeller Foundation by one of the many European scholars who owe to this noble institution – the symbol of American generosity – the privilege of continuing their scientific work in a free country”. According to the original publisher, “Kelsen presents in Society and Nature his sociological study of the relationship between the principle of retribution and the law of causality. It is at the same time a study in intellectual history illustrating the metamorphosis of a primitive idea into a scientific conception. The principal thesis of the book is that the modern notion of causality had its origin in the primitive notion of retribution.
